A family camping trip on the Fourth of July holiday weekend turned tragic when a young girl was killed while sitting in a tent.

The mid-afternoon incident occurred at Yogi Bear’s Jellystone Park Campground at Tall Pines in Elmer, New Jersey. The 3-year old from the Bronx was in a tent when a branch from a tree fell on it. She was transported to a nearby hospital where she later died. Another child in the tent at the time was not injured.

At the time of the accident, there were strong storms, including a small tornado passing through the area. As of now, it is unclear whether the weather caused the accident.

Jellystone Park is a chain of more than 80 campgrounds in the U.S. and Canada. The family-based camp-resorts are franchised through Leisure Systems, Inc., which is a subsidiary of Cincinnati-based The Park River Corporation.

The Tall Pines campground is known for its many tall trees.

In a statement, a company spokesman stated that “… providing a safe camping experience is always our priority.”

Claims for Injuries Caused by Accidents on Someone’s Property Fall under Premises Liability

Premises liability is a legal term describing those personal injury cases where harm was caused by some unsafe or defective condition on someone’s property.

New Jersey law establishes codes for reasonable care for the injury threats. These statutes and regulations apply to owners and managers of private and public properties as well as government agencies and commercial entities that maintain properties.

Could there have been negligence in property management at the Jellystone Campground? An injured person must prove that the property owner failed to use reasonable care in either maintenance or ownership of the property or both.
